Effective Date of MBR Increases Delayed

In November 1992, landlord applied for 1992–93 MBR rent increases for five buildings. The DRA ruled against landlord in May 1993, finding that the violation certification requirements hadn't been met. Landlord challenged that order, and the DRA found that landlord had fixed enough violations to qualify for MBR increases effective June 1993. Tenants then appealed, claiming that many violations hadn't been corrected. The DHCR ruled for tenants in part. Landlord had properly certified that the required number of violations was cleared.

But since landlord didn't file its proof until April 1993, collection of the MBR increases was delayed until Nov. 1, 1993, six months after landlord had submitted its proof.
