MCI Rent Hike Granted for Sidewalks and Walkways

Westchester landlord applied for MCI rent hikes based on the installation of a sidewalk and walkways around the building. The DRA ruled for landlord. Tenants appealed, claiming that they didn't benefit from the work, that it was cosmetic in nature and done to attract new tenants, that the work could have been done less expensively, and that the driveways flooded and backed up all the time. The work qualified as an MCI, and landlord submitted all the proper documentation. The regulations didn't require landlord to choose the lowest price to complete an MCI.
