MCI Increase Reduced for Scaffolding Cost Before Work Period

Landlord applied for MCI rent hikes based on pointing, waterproofing, and exterior work, along with related scaffolding and professional engineering services. The DRA ruled for landlord, and tenants appealed. Among other things, tenants claimed that the scaffolding was put up long before the facade work was performed. The DHCR ruled for tenants. The scaffolding was erected in January 1999. But landlord didn't begin the MCI work until December 2000. So the DHCR deducted the cost of the scaffold rental for the 23 months before work began from the total MCI cost.
