MBR Rent Hike Denied Due to Building Violations

Landlord applied for 2000-01 MBR rent hikes. The DRA ruled for landlord. Tenant appealed and won. Tenant claimed that landlord hadn't cured enough building violations to qualify for MBR hikes. Nine rent-impairing violations were placed on the building between Jan. 1, 1997, and Jan. 1, 1999. There was no proof that these violations were cured in time for landlord to get MBR hikes for the 2000-01 cycle.
