Long-Term Tenant Proves She's Rent Controlled

Landlord asked the DHCR to rule on tenant's status. Landlord claimed that tenant was unregulated. Tenant claimed that she was rent controlled. Prior landlord had filed a 1985 registration indicating that tenant was rent controlled. Tenant also submitted a copy of a rent and security deposit receipt she received dated Oct. 24, 1969, as well as a 1982 decision from the DHCR's predecessor city rent agency which ruled that tenant was rent controlled. The DRA ruled for tenant. Landlord appealed and lost. The 1982 rent agency order and tenant's other proof showed that she was rent controlled. The DHCR's own records also showed that a prior landlord withdrew an application for a certification of eviction against tenant in 1985.
