Two Long-Term Tenants Are Rent Controlled

Two building tenants claimed that they were rent controlled after landlord said that it was selling the building and wanted them to move out. Landlord claimed that decontrol reports were filed on both apartments years earlier. The DRA ruled against tenants. Tenants appealed and won. Tenants didn't wait too long to claim rent-control status. They had lived in the building for years and paid low rents. They complained in 2008 as soon as landlord stated that it was going to sell and seek their eviction. And the decontrol reports weren't reliable.

Both tenants showed that they had lived in the apartments since before June 30, 1971. They never moved out. And landlord mistakenly gave one of the tenants rent-stabilized leases starting in 1972.
