Lease Renewal Complaint to DHCR Dismissed After Tenant Moved Out

Rent-stabilized tenant complained in March 2020 that landlord failed to give her a renewal lease. In March 2021, tenant notified the DHCR that she had moved to a new address and no longer lived in the apartment. The DRA therefore terminated the complaint proceeding.
Tenant appealed and lost. Tenant argued that she had been overcharged. But tenant's renewal lease violation complaint had been properly terminated. Any new issue of rent overcharge was beyond the scope of that proceeding. Tenant could file a rent overcharge complaint with the DHCR or with a court.
