Leaks in Apartment Unrelated to MCI

The DRA granted landlord's MCI rent increase application based on pointing and waterproofing. Tenant appealed, claiming that water was still leaking into his apartment. The DHCR ruled against tenant. Landlord had submitted proof to the DRA that all hazardous "C" violations at the building had been cleared. And tenant admitted that the leaks in question were caused by the upstairs tenant. There was no connection between the leaks and the pointing work.
