Law Cited Doesn't Apply to Above-Ground Tanks

The Fire Department issued a violation notice to landlord for not providing supports for its oil tank. Landlord claimed that the rule didn't apply because its heating oil storage tank was above ground. The ALJ ruled against landlord and fined it $100. Landlord appealed and won. The ruled cited in the violation notice applies to underground tanks; it doesn't mention above-ground tanks.
