Late Registration Filing Eliminated Overcharge

Tenant complained of a rent overcharge. Tenant pointed out that landlord hadn't registered his apartment since 1994. The DRA ruled for tenant. Although the rent was otherwise legal, it was frozen at the base rent charged four years before the filing of tenant's complaint in 2001. Landlord appealed. Landlord had filed late registrations for the years 2001--04 during 2004, before the DRA decided the case. The DHCR ruled for landlord. Landlord's late registration filing eliminated the rent freeze before the DRA ruled on the case. There was no overcharge.
