Landlord's Efforts to Clean Sidewalk Insufficient

DOS issued a violation notice to landlord for having a dirty sidewalk in front of her building. The DOS inspector found a large amount of matted, scattered pieces of papers, tissues, and wrappers on the sidewalk at 9 a.m. Landlord claimed that she cleaned the area at 6 a.m. daily and then again at 2 p.m. after she returned from work. She claimed that there was heavy pedestrian traffic on the block and that students from the school next door left a lot of garbage and debris in front of her building. The ALJ ruled against landlord and fined her $100. Landlord appealed and lost.
