Landlord Used Acceptable Material for New Roof

Landlord applied for MCI rent hikes based on the installation of a roof. The DRA ruled for landlord. Tenant appealed, claiming that landlord didn't use the roofing material stated in its MCI application. The DHCR ruled against tenant. Landlord used a modified asphalt membrane that met the DHCR's criteria for roof replacement. The work qualified as an MCI.
