Landlord applied for MCI rent hikes based on elevator upgrading. The DRA ruled for landlord. Tenants appealed, claiming, as they had before the DRA, that the elevator upgrade was repair work and that the elevator still didn't work properly. The DHCR ruled against tenants. It is DHCR policy that elevator upgrading, which includes the installation of new controllers/selectors, qualifies as an MCI. And elevator inspection certificates from DOB stated that the work conformed to local requirements.
