Landlord Requested Useful Life Waiver Too Late

Landlord applied for MCI rent hikes based on pointing and waterproofing. The DRA ruled against landlord because the useful life of the prior pointing and waterproofing work hadn't expired. Landlord appealed and asked that the useful life requirement be waived. The DHCR ruled against landlord. To qualify for the waiver of the useful life requirement, landlord must request the waiver before performing the MCI.
