Landlord appealed, claiming that he didn't know there was a useful-life waiver application requirement. The DHCR ruled against landlord. Landlord should have applied for a waiver of the useful-life requirement before he applied for the MCI increase. This requirement was issued in DHCR Operational Bulletin 90-2.
