Landlord Proves No Sprinkler System Required at Building

DOB issued two violation notices to landlord, one for a defective fire escape and the other for not having an automatic sprinkler in the third-floor hallway of the building. Landlord fixed the fire escape, but argued that no sprinkler system was required in the building. The ALJ ruled against landlord and fined it $1,000. Landlord appealed and won. The building was constructed before the 1968 Building Code went into effect. So, under Code Section 27-954, no sprinkler system was required, because the building contained only three apartments. The fine was revoked.
