Landlord Didn't Test Building Sprinkler System

The Fire Department issued a violation notice to landlord for failing to arrange for a performance flow test of the residential sprinkler system in the presence of an FDNY representative. Landlord then scheduled the sprinkler test for May 15, 2015, which was after the first-scheduled hearing date of Feb. 27. The ALJ fined landlord $600. Landlord appealed and lost. Landlord claimed that the system didn’t require the sprinkler system test at the time the violation was issued. But ECB wouldn’t consider new evidence on appeal.
