Landlord Proved Sheetrock Tied for Collection

DOS issued a violation notice to landlord for leaving sheetrock, wood, and cardboard boxes out for collection at curbside without properly tying or bundling them. Landlord claimed that the sheetrock and a wooden door were securely tied before being placed out for collection. Landlord claimed he left no cardboard boxes out. Landlord submitted a photograph of the items tied up at curbside, as proof. The ALJ ruled against landlord and fined him $50. Landlord appealed. ECB found landlord's claim credible, ruled for landlord, and revoked the fine.
