Landlord Proved Improvement Costs

LVT Number: 14320

Tenant filed a fair market rent appeal. The DRA ruled against tenant. The allowable fair market rent was higher than the actual first stabilized rent charged to tenant. Tenant appealed, claiming that landlord wasn't entitled to the amount of rent increase granted for apartment improvements. The DHCR ruled against tenant. Landlord proved that it had spent $17,000 on apartment improvements. The DRA made a calculation error in totaling the improvement costs and rent increase, but the rent charged was still less than the permissible fair market rent.
