Landlord Must Replace Canopy

Tenants complained of reduced services building-wide, based on a number of conditions. An inspection supported tenants' complaint, and the DRA reduced tenants' rents. The DRA also directed landlord to replace the ripped canopy at the building's entrance. Landlord appealed, claiming that the canopy wasn't a required service. The DHCR denied landlord's PAR. Although landlord didn't register the canopy as a building service, it had been provided for a long time. So, landlord must repair or replace it.
