Landlord Installed Three Radiator Covers in Tenant's Apartment

Tenant complained of a rent overcharge. When he moved into the apartment, his monthly rent was $2,500. The DRA ruled for tenant and reduced his rent to under $2,000. Landlord appealed, claiming that the DRA incorrectly disallowed the cost of certain 1/40th improvements in calculating the legal rent. The DHCR ruled for landlord in part. Landlord paid $2,000 for four radiator covers, but admitted that only three were installed in tenant's apartment. So the DHCR allowed 1/40th of $1,500 to be added to tenant's rent. The legal rent was $1,977.
