Landlord Illegally Altered Two-Family House

DOB issued a violation notice to landlord for illegally converting a mixed-use two-family residence with a store into four apartments. The ALJ fined landlord $48,000 for a hazardous violation, including per-day penalties of $1,000 per day. Landlord appealed, claiming that the Code Section that DOB cited applied only to buildings used solely for residential purposes. ECB ruled against landlord. Code Section 28-210.1 also applied to mixed-use buildings.
