Landlord Gets $270,000 in Rent Due

Landlord sued tenant for back rent and other damages in New York County Supreme Court. The court ruled for landlord, awarding $270,000 in rent due. Tenant appealed, claiming that the mere issuance of an eviction warrant in a prior summary nonpayment proceeding cancelled the obligation to pay future rents. The court found no merit in this argument. The stipulation in the nonpayment proceeding reserved landlord's right to all other claims.
