Landlord Fined for Not Filing Backflow Prevention Device Test Reports

DEP issued three violation notices to landlord for failing to submit annual test reports for three backflow prevention devices at its building. DEP’s inspector testified that, as of the hearing date, DEP hadn’t received any of the required annual reports. The ALJ ruled against landlord and fined it $1,500. Landlord appealed and lost. Landlord didn’t dispute that it hadn’t filed the test reports and the fact that it couldn’t find the plumber who installed the BPDs was no defense.
