Landlord Fined $700 for Failing to Test Backflow Prevention Device

DEP issued a violation notice to landlord for failing to install backflow prevention device(s) and/or failure to submit initial test reports to DEP. By the time of the initial hearing, landlord had conducted testing and filed certification with DEP. But the ALJ still fined landlord $700. Landlord appealed and lost. To avoid any penalty for this offense, landlord must test the backflow prevention device upon installation and submit an initial test report to DEP before any violation summons is issued.
