Landlord Fined for Improper Gas Piping

DOB issued violation notices to landlord in connection with improper installation of gas piping or equipment without a permit. Landlord claimed that DOB didn’t reasonably attempt to deliver the violation notices to a person upon whom service could be made before affixing them to the building. The ALJ ruled against landlord and fined it $3,900. Landlord appealed and lost. DOB made a reasonable attempt to deliver the violation notices. DOB’s inspector spoke with tenants who all told him they weren’t authorized to accept the notices on behalf of landlord. Landlord didn’t claim that anyone representing the landlord was at the building and could have accepted the notices. Landlord also raised a preexisting condition defense but submitted insufficient proof.
