Landlord Didn't Prove Ownership
LVT Number: 8872
Landlord sued to evict tenant. Tenant argued that landlord didn't own the apartment, so he couldn't sue for tenant's eviction. Landlord claimed he didn't need to prove ownership because he'd presented the court with a lease with the names of landlord and tenant, which were the same names appearing on the court papers. The court ruled for tenant, and prevented the eviction. Landlord had no right to evict tenant because he didn't prove he owned the property. Proof of ownership is required to enforce a lease.
