Landlord Didn't Clear Housing Violation

Landlord applied for 2002–2003 maximum based rent (MBR) increases. The DRA ruled against landlord based on landlord's failure to meet building violation clearance requirements. Landlord appealed and lost. To qualify for 2002–2003 MBR increases, landlord must have cleared all rent impairing violations and at least 80 percent of all other building violations recorded on Jan. 1, 2001, if the application was filed by June 30, 2001, or as of six months before the date of filing if the MBR application was filed after June 30, 2001.

In December 2003, the building still had one rent impairing violation, rat droppings. So landlord didn't clear this violation on time for the 2002–2003 MBR cycle.
