Landlord Didn't Clear Debris Often Enough

DOS issued a violation notice to landlord for having a dirty sidewalk in front of its building one afternoon at 4 p.m. The inspector found paper bags, newspapers, candy wrappers, and other debris scattered and matted all around the sidewalk. Landlord claimed that it cleaned in front of the building at 7 a.m. and in the evening every day. Landlord said the downstairs commercial tenant also cleaned at 10 a.m. and 2 p.m. The ALJ ruled against landlord and fined it $100. Landlord appealed, claiming that it made reasonable efforts to clean. ECB ruled against landlord. The area had heavy traffic. The fact that there was so much garbage in front of the building at 4 p.m. when landlord testified there would have been three cleanings by that point showed that landlord's efforts were insufficient.
