Landlord Claims Tenant Responsible for Cleaning Sidewalk

DOS issued a violation notice to landlord for having a dirty sidewalk. Landlord claimed that tenant was responsible for cleaning the sidewalk. The ALJ ruled against landlord and fined him $50. Landlord appealed. ECB ruled against landlord. Landlord is legally responsible for maintaining a clean sidewalk. The fact that this was landlord's first violation in 10 years was irrelevant; landlord received the minimum fine under law.
