Landlord Can Evict Condo Tenants

Facts: New landlord bought six unsold condominium apartments from sponsor and sued to evict tenants after their leases expired. Tenants claimed that they were protected from eviction under the Martin Act as nonpurchasing tenants. Court: Landlord wins. Tenants didn't move into the apartments until after the condo conversion. So they weren't nonpurchasing tenants at the time the building went condo and weren't entitled to Martin Act protection from eviction.
