Landlord Can Convert to Automatic Elevators

Landlord asked the DHCR for permission to convert a manually operated passenger elevator to an automatic one. The DRA ruled against landlord because the new CCTV/security system that landlord installed in connection with the service substitution wasn't hooked up to live monitoring. The DRA found that, without the closed circuit TV, the automatic elevator didn't provide the security provided by the elevator operators. The DHCR denied landlord's PAR. Landlord then filed an Article 78 court appeal, and the case was sent back to the DHCR for further consideration.

Landlord could convert to automatic elevators as long as: (1) the CCTV/video recording system was hooked up; (2) the former elevator operators worked as lobby attendants from 7 a.m. to 12 a.m.; and (3) video intercoms were installed in all regulated apartments as an added security measure.
