Landlord Can Charge for Remote Control Unit to Garage Access

Tenant complained of a rent overcharge. The DRA ruled against tenant, and tenant appealed. The DHCR ruled against tenant. Landlord provided tenant with access to the ancillary garage area, even if there was some inconvenience for tenant in using the remote control. Tenant had to pay a garage door company an annual fee of under $35 for the remote control. Tenants had voted to use this method of access. The renting of the remote control was voluntary.
