Landlord Agreed Not to Seek Back Rent

Landlord sued to evict tenant for nonpayment of rent. Landlord's rent demand included back rent that it claimed was owed under a DHCR order. The court ruled against landlord. In a prior nonpayment case, landlord and tenant signed a settlement agreement ''with prejudice.'' This indicated that any claims for rent that were outstanding at that time were resolved and barred landlord from now seeking old rent that might be due under a DHCR order.
