Tenant complained of a rent overcharge. The DRA ruled for tenant, finding a total overcharge of $1,500. Landlord appealed, claiming it wasn't given a rent increase of 1/40th of the labor cost for improvements made to tenant's apartment. The DHCR ruled against landlord. Landlord's employees performed the labor related to the improvements. Landlord didn't produce any records showing the actual cost of the labor, if any, in addition to the employees' normal wages. So the DRA was correct in denying any rent increase for the labor costs.
