Information Missing from Comparative Hardship Application Form

Landlord, a cooperative building, applied to the DHCR for rent increases based on comparative hardship. The DRA ruled against landlord because landlord's application was missing information, such as the amount of rent increases requested, the average net income for the period in question, and operating expenses. Landlord appealed, claiming it didn't have all available information at the time it submitted the application, which had to be filed within six months of the end of the current three-year period landlord was using for comparison purposes.

Landlord also later supplemented its original submission to the DRA. The DHCR again ruled against landlord. Landlord's comparative hardship application was incomplete. Landlord didn't explain why its application was incomplete when first submitted, submitted a supplement two years after the information became available, and never resubmitted a completed application form.
