Hot Water Heaters Never Inspected by DOB

DOB issued a violation notice to landlord for supplying gas to the building's hot water heaters without DOB inspection and certification. Landlord claimed that the equipment was in place before she bought the building in 2006. The ALJ ruled for DOB and fined landlord $1,000. Landlord appealed and lost. Landlord was in violation of the city's Fuel Gas Code (FGC). The pre-existing condition was no defense to FGC Section 406.6.2, which requires that before gas is introduced into a system of new gas piping, the entire system must be inspected to determine that there are no open fittings or ends and that all valves at unused outlets are closed and plugged or capped.
