Hot Water Heater Installed Without Permit

DOB issued two violation notices to landlord, one for failing to maintain a hot water heater in good working order and the other for installing a hot water heater without a permit. Landlord claimed that his plumber caused the violation by removing the coil from the boiler and installing a separate hot water heater. The ALJ ruled for landlord and dismissed the violation. DOB appealed and won. Even if the plumber caused the improper repair of the boiler and faulty installation of the hot water heater, landlord was responsible for the violation by law. Landlord was fined $830.
