Heat and Hot Water Violation Prevents MBR Increase

Landlord filed a 2012-2013 violation clearance certification to establish maximum base rents (MBRs) for rent-controlled tenants. The DRA ruled against landlord, finding that landlord failed to comply with all the requirements for MBR increases. Landlord appealed and lost. HPD records showed that a rent-impairing heat/hot water violation was on record. Landlord claimed that tenant's complaint to HPD had been closed and that tenant was deceased.

But the violation was on record without proof of correction on or before June 23, 2011, when landlord filed its violation certification with the DHCR.
