Landlord applied for MCI rent hikes based on the installation of a new boiler/burner. The DRA ruled for landlord. Tenants appealed, claiming that there were hazardous violations at the building and that this barred the MCI rent hike. The DHCR ruled for tenants. There were six hazardous violations on record with HPD, including one for lack of adequate heat. The DRA should have denied landlord's application.
