Hazardous Violations on Record

Landlord applied for MCI rent increases based on a number of installations. The DRA ruled for landlord, and tenants appealed. They claimed that landlord wasn't maintaining services at the building. HPD records showed that there were 13 immediately hazardous violations on record at the building. Tenants had raised this issue before the DRA. The DHCR ruled for tenants. HPD records showed that the violations were on record before the DRA's order was issued. Rent Stabilization Code section 2522.4(a) (13) states that no MCI rent increases may be granted if landlord isn't maintaining all required services or if there are immediately hazardous conditions relating to the maintenance of building services.
