Gas Line Restored

Tenants complained of a rent overcharge. Landlord claimed it was entitled to collect a 1/40th rent hike for installing a new gas link because prior tenants didn't have gas service. The DRA ruled that restoring gas service is normal maintenance for which landlord can't get a rent increase. Landlord appealed, and the DHCR ruled for tenants. According to the apartment registration, gas is a required service, so restoring the service can't qualify as an improvement---it's normal maintenance work.
