Failure to Paint Doesn't Block MBR Increase

Tenant objected to landlord's collection of 1998-99 MBR rent increases. The DRA ruled against tenant. Tenant appealed, claiming that landlord improperly certified that it maintained essential services, because it hadn't painted tenant's apartment. The DHCR ruled against tenant. The failure to paint an apartment isn't an essential service for MBR purposes.
