Electrical Work Doesn't Qualify

Landlord applied for MCI rent hikes based on installation of electrical equipment. The DRA ruled against landlord, and landlord appealed. The DHCR again ruled against landlord. In order for electrical upgrading work to qualify as an MCI, landlord must install new electric service to the building as well as new copper risers and feeders that extend from the property box in the basement to every apartment. These risers and feeders must be of sufficient capacity to accommodate the installation of air conditioner circuits and outlets as well as two double outlets in the kitchen.

Landlord's work didn't qualify. Landlord spent $6,000 to upgrade the electrical service up to the panel boxes in the basement in anticipation of further upgrading but submitted no proof of further work.
