DRA Miscalculated MCI Rent Increase

Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed. Landlord claimed that the DRA incorrectly calculated an MCI increase that the DHCR had added to tenant's rent. The DHCR ruled for landlord. The DRA incorrectly based the percentage of tenant's MCI rent increase on the April 1, 1984, rent instead of the September 1, 1984, rent as specified in the MCI order.
