DRA Applied Incorrect Lease Term

Tenant complained of a rent overcharge. The DRA ruled for tenant, finding an overcharge of $757. Landlord appealed, claiming there was no overcharge. The DHCR ruled for landlord. The DRA incorrectly calculated tenant's three-year renewal lease, commencing on Jan. 1, 1982, as a two-year lease. Upon recalculation, there was no overcharge.
