DHCR Inspector Found No Evidence of Mold in Apartment

Tenant complained of a reduction in services, claiming that there was mold in her bedroom and bathroom. Tenant submitted a copy of a mold inspection report prepared by a consultant she hired. The DRA ruled against tenant since its inspector found no visual evidence of mold on the drywall of the apartment. The DHCR’s inspector did find wet water stains and bubbles on the bathroom ceiling, as well as peeling paint and cracks on the ceiling and unworkmanlike drywall repairs. The inspector also measured a moisture meter reading of 100 percent.

Tenant appealed and lost. The DRA properly limited its review to the mold complaint raised by tenant.
