DHCR Inspection Found That Vermin Control Was Maintained

LVT Number: #31260

Rent-stabilized tenant complained of a reduction in building-wide services. Tenant claimed that vermin control wasn't maintained in the building's public areas. Landlord denied the condition. The DHCR's inspector found no evidence of roaches or droppings in the hall, staircase, elevator, laundry room, or incinerator/incinerator room. The DRA ruled against tenant, who appealed and lost. There was no merit to tenant's claim that the DHCR inspection was conducted incorrectly.

There was no merit to tenant's claim that the DHCR inspection was conducted incorrectly. The inspector wasn't required to interview building tenants or to report in minute detail the areas in the building that were inspected. The DHCR inspected the common areas listed in tenant's complaint. Access to tenant apartments wasn't required. And there was no mandatory number of photographs required to be taken. The DHCR also wasn't required to document the entire physical inspection. Finally, tenant's submission of an HPD pest violation issued for his apartment was beyond the scope of review for this building-wide service proceeding.
