DHCR Can't Rule on Tenant's Claim for Interest on Security Deposit

Tenant complained of rent overcharge. The DRA ruled against tenant, finding no overcharge. Tenant appealed and lost. Tenant still claimed rent overcharge and also claimed that landlord never paid her interest on her security deposit. The DHCR found that all rent increases after the base rent date were lawful. And the DHCR couldn't address tenant's security deposit claim.

Tenant still claimed rent overcharge and also claimed that landlord never paid her interest on her security deposit. The DHCR found that all rent increases after the base rent date were lawful. And the DHCR couldn't address tenant's security deposit claim. Tenant could bring a case in small claims court or contact the Consumer Frauds and Protection Bureau of the NY State Attorney General's Office to address the issue of return of interest on a security deposit.
