Court Grants Delay in Evicting Tenant Based on Hardship

Landlord sued to evict tenant for chronic nonpayment of rent after commencing eight nonpayment proceedings against tenant within 30 months. In each case, tenant paid the back rent owed and didn't raise defenses. Tenant said that she got behind on her rent between 2015 and 2017 while caring for a sick parent. Because tenant was a long-term resident and relocation could make it difficult to find a new school for her young, learning-disabled son, the court gave landlord a final judgment of possession but stayed execution on the eviction warrant on condition that tenant pay her rent in the future by the fifth of each month.
